Purchasing a property in Spain as an expatriate resident or as a non-resident is not by itself such a complicated matter. However, the dream can also turn into a nightmare if you have not been advised properly. Spanish laws and regulations are sometimes very different from those common in other countries. What is the normal procedure in Spain once you made up your mind for a property?

The first important step is to check at the "Property registry office" that the seller is the exclusive owner of the property. Once you have no doubt about the ownership status of the property, it is common to issue a purchasing contract that will be signed by both parties. At the same moment, the buyer has to make a down payment covering part of the agreed purchase price, generally 10%. Both the seller and the buyer are now mutually engaged. As a buyer, it prevents you from the seller changing his mind and making the deal with somebody else until the meeting has been arranged at the notary office.

The transfer of property is registered and legalized by signing, in a Spanish notary office, the title deed of conveyance (also called "escritura de compraventa"). At the same moment, the payment of the full price (less the down payment made while signing the purchasing contract) is made by the buyer.

The duly signed title deed of conveyance (or "escritura de compraventa") will be passed by the notary office to the "Property registry office" where it will be registered. The transfer of property is now finalised and you are from that moment on registered officially as the new owner of the property with all inherent legal rights and obligations.
